In California, the Fair Housing and Employment Act (“FEHA”) is the primary statute that prohibits harassment and discrimination based on protected classes including race, religion, color, national origin, ancestry, disability(ies), medical condition, genetic information, martial status, gender, gender identity, gender expression, sexual orientation, age, military background, and/or pregnancy. (Govt C §12940(j)(1)).
For an employer or an individual to be liable for harassment, several elements must be met. First, the victim must be a member of a protected class. Second, the victim’s harassment must be based on their membership in the protected class. Finally, the harassment must be either severe or pervasive to alter the conditions of their employment or create an abusive environment.
Some common forms of hostile workplace harassment are as follows:
- Discrimination based on one of the aforementioned categories
- Sexual harassment- making sexual jokes and lewd remarks
- Threats of physical and non-physical harm
- Offensive comments
- Using racial slurs or other racial commentary
- Commentary about a person’s age
- Inappropriate physical contact
Although these are just examples of the types of conduct that may give rise to a claim of hostile workplace harassment, it is important for anyone who believes they have been a victim of harassment to report the harassment to their employer and seek advice of an attorney immediately after the incident.
