Discriminating against an employee based on their sex and/or gender is prohibited in the workplace under both Federal and State Law. Although sex and gender discrimination are closely related, they are two distinct offenses. Sex discrimination specifically refers to adverse employment actions based on the employees’ sex- whether the employee is genetically male or female. Gender discrimination refers to how an employee identifies themselves. Both are unacceptable and have dire consequences for employers who violate the law.
